Importância da administradora condominial
Empresa é vital para saúde do condomínio, diz especialista.
A auto administração, comum nos condomínios antigamente, tornou-se impraticável nos dias de hoje. Se antes ela era uma opção mais econômica, especialmente para prédios de menor porte, atualmente a situação é outra, explica o advogado Daphnis Citti de Lauro, especialista em Direito Imobiliário.
“Este tipo de auto gestão requer o trabalho de, no mínimo, um contador e um advogado, o que acaba saindo mais caro que o valor de uma taxa de administração. E também não compensa tecnicamente, porque o trabalho necessário para uma boa e competente administração envolve conhecimento de várias áreas, além do atendimento a inúmeras normas e exigências tanto fiscais quanto trabalhistas e até mesmo de medicina do trabalho”, diz o advogado.
Muitas vezes mal vistas pelos condôminos, as administradoras têm papel fundamental no dia a dia do condomínio. “Entre diversas funções, elas são responsáveis por orientar os síndicos, convocar assembleias, participar delas e normalmente elaborar as atas, além de registrá-las em cartório e distribuí-las”.
Daphnis de Lauro lembra que há ainda a emissão dos boletos de cobrança, a baixa dos pagamentos, a cobrança dos inadimplentes, o controle de despesas, a cotação para obras, entre outras.
“Sem contar a obrigação de emissão da NFTS (Nota Fiscal de Tomador de Serviço), retenção do ISS (Imposto Sobre Serviços) na fonte, brigada de incêndio, CIPA, PPRA, vistoria do para-raios, recarga dos extintores, limpeza da caixa d’água e desinsetização, contratação e dispensa de funcionários, etc”, completa o especialista.
À administradora também cabe notificar os condôminos que descumprem as normas da convenção ou do regulamento interno, intermediar os conflitos e também o relacionamento entre condôminos, síndico e funcionários. E deve ainda elaborar os balancetes mensais, com os documentos comprobatórios das despesas do condomínio e os enviar aos conselheiros. Posteriormente, precisa responder às dúvidas e observações do conselho.
“Por tudo isso, os condôminos e, principalmente, os síndicos devem ser orientados a não escolher a administradora pelo preço, mas sim pela honestidade e competência. Todo trabalho deve ser remunerado e, quem trabalha bem, tem que receber à altura. Qualquer erro administrativo poderá resultar em graves consequências, principalmente financeiras”, finaliza Daphnis de Lauro.
